“User” or “You” refers to the person using the Platform.

“Entitlement” or “Entitlements” refers to the user’s right to access or use the Services offered and includes but not limited to, coins, unlock items, prizes, bonuses, other game achievements.
“Game” or “Games” refers to all activities organized by us on our Platform and includes Promotional Games, Practice Games, Tournaments, Cash Games and Non-Cash Games, and any other contest.

Additionally, you represent that you are neither a politically exposed person, convicted for any crime, on the UN Sanctions List nor work for an organization that is on the UN Sanctions List.
If you are an officer, director, employee, consultant, or agent of our company or a relative of such persons ("Associated Person"), you are not permitted to play either directly or indirectly, any Games which entitle you to any prize on the Platform, other than in the course of your engagement with us. For the said purposes, the term 'relative' shall include spouse, parents, and children who are financially dependent.   

E. LICENSE   

The Services offered on our Platform are licensed to you, which are limited, non-transferable, non-assignable, non-exclusive but revocable license to use and access for only non-commercial purposes, subject to the terms and conditions laid down in this Agreement.   

F. LEGALITY AND RESTRICTIONS ON USE

If you access our Services for making any deposit or playing Games from a jurisdiction such Games are not permitted, you shall be solely liable for any legal or penal consequences arising thereof, and we shall be entitled to forfeit the balance and entitlements in your user gaming account.

G. USER OBLIGATIONS   

You agree:

d)not purchase, sell, trade, rent, lease, license, grant a security interest in or transfer your user gaming account, content, entitlements such as currency, points, standings, rankings, ratings, or any other attributes that may appear in, originate from, or associate with the Platform.
e)not to use the Platform in any manner which could disable, overburden, damage, or impair the Platform or interfere with or disrupt any other person’s use and enjoyment of the Platform or the Services provided therein, including access or attempt to access the Services through another person’s user gaming account.
f)not to obtain or attempt to obtain any materials, content, or information through any means not intentionally made available or provided through the Platform.

i)not to engage or attempt to engage in cheating, collusion, manipulation, or any other prohibited activities.

k)not to access or attempt to access this Platform through any automated means including the use of scripts or web crawlers and agree not to run any form of spam or auto-responder on the Platform.
l)not to use this Platform in any way which infringes any patent, trademark, copyright, trade secret, database right, other intellectual property rights, right of confidence, or other rights of any other person or which breaks any law or breaches any contract. Additionally, you or any person authorized by you shall not co-brand this Platform, frame this Platform, and download any content from this Platform without the express prior written permission of an authorized representative . ii.is otherwise objectionable or undesirable, whether or not unlawful;

iv.would constitute an incitement to commit a criminal offence;
v.violates the rights or intellectual property of any person;
vi.promotes a competing service or product; or
vii.is a political campaign, commercial solicitation, a chain letter, mass mailing, or any form of spam, junk mail, or advertising which has not been expressly authorised by us in writing,
viii.is likely to interrupt, damage, or impair in any way any access to this Platform,
ix.results in the introduction of any software virus, trojan, worm, logic bomb, or other material, which is malicious or technologically harmful interfering with, damaging or destroying the proper function of this website or corrupting or destroying any content or other information of software or source code,
x.violate any law in force at the relevant time.
n)not to use this Platform for any unlawful purpose or in any way which is unlawful. H. ADDITIONAL USER OBLIGATION

You understand, acknowledge, and agree that we never ask for your user gaming account login password.

L. REGISTRATION, VERIFICATION, AND MODIFICATION   

To use our Services, you will have to download the Mobile Application from the website and register with us by creating an account on the Website.
Registration & Modification: The account can be opened by choosing a unique username and setting a unique password. You will be required to provide personal information for your user gaming account verification and/or for adding cash to your user gaming account such as email address and mobile number for generating a one-time password (OTP). M. RULES OF CONDUCT, BREACH & TERMINATION   

In the event, we determine that you may have violated the terms in this Agreement including but not limited to unlawful, improper, or fraudulent use, we may suspend or terminate or put restrictions on your access to, and use of, your user gaming account or our Services. We may issue a warning prior to the suspension or termination, and you will not be able to access or recover your account or be entitled to a refund of your entitlements, as the case may be.
Further, any personal information which is of such nature that requires protection from unauthorized dissemination shall be dealt with under this section. The action taken by the Company shall be final and binding on you and shall be without prejudice to our other rights and remedies available under the law or equity.
The rules of conduct include the following:
Multiple IDs: Your registration on the Platform is restricted to a single user gaming account which will be used by you to avail of the Services provided on the Platform. You are prohibited from creating or using multiple user IDs for registration.

Money Laundering: You are prohibited from doing any activity on the Platform that may be construed as money laundering, including, without limitation, attempting to withdraw cash from unutilized cash added through credit cards or intentionally losing money to any player(s).
Transfer or entitlements: Winnings, bonuses, and prizes are unique to the player and are non-transferable. In the event you attempt to transfer any such entitlement(s), we reserve the right to forfeit it and you are not entitled to recover or claim such entitlement(s).
Other reasons: If there is a reasonable belief, in our sole discretion, that your continued access to or use of the Platform is detrimental to our interests, other users, or in the larger public interest, we may, in our sole discretion take any or all, of the below-mentioned actions:

e)Initiate prosecution for violations that amount to offences under the law in force;
f)Additionally, bar you from future registration on the Platform, in the event of a material breach;   

N. LIMITATION OF LIABILITY   

In addition to specific references to limitation of liability of the Company elsewhere in the Terms, under no circumstances, including, without limitation, in contract, negligence, or any other tort, shall the Company be liable for any injury, loss, claim or damage to property, general damages, whether direct or indirect, special, incidental, consequential, exemplary or punitive damages, of any kind whatsoever arising out of, or in connection with, your access to, or use of, or inability to access or use, the Services on the Platform. You further agree to indemnify us that includes our Service Providers and licensors, against any claims in respect of any such matter(s).
Without limiting the generality of the foregoing, you specifically acknowledge, agree, and accept that we are not liable to you for:
a)the defamatory, undesirable, or illegal conduct of any other user of the Services;
b)any loss whatsoever arising from the use, abuse, or misuse of your user gaming account or any feature of our Services on the Platform;
c)any loss incurred in transmitting information from or to us or from or to our Platform by the internet or by other connecting media;
d)any technical failures, breakdowns, defects, delays, interruptions, improper or manipulated data transmission, data loss or corruption or communications infrastructure failure, viruses, or any other adverse technological occurrences arising from, or in connection with, your access to, or use of, our Platform;
e)if you are unable to play, participate in any Game, contest, or competition due to any error or omission, whether or not attributable to us, including technical or other glitches.
f)the accuracy, completeness, or currency of any information Services provided on the Platform;
g)any delay or failure on our part to intimate you where we may have concerns about your activities; and
h)your activities/transactions on third-party websites or apps accessed through links or advertisements posted on the Platform.
Notwithstanding anything to the contrary contained in the Terms or elsewhere, you agree that our maximum aggregate liability for all your claims under this Agreement, in all circumstances, other than for the payment of any withdrawable balance in your user gaming account, shall be limited to Indian Rupees One Thousand only (INR. 1,000/-).   

O. DISCLAIMER AND INDEMNITY   

Disclaimer: The Services provided on the Platform and the Content therein are provided strictly on an "as is" basis. Any representations, conditions, warranties, or guarantee whatsoever, express, or implied, including, without limitation, any implied warranty of accuracy, completeness, uninterrupted provision, quality, merchantability, fitness for a particular purpose are specifically excluded to the extent permissible by law. b)defamatory, offensive, or illegal conduct of any other player or for anything that turns out to be misleading, inaccurate, defamatory, threatening, obscene, or otherwise illegal whether originating from another player or otherwise;
c)use, abuse, or misuse of your user gaming account on our Platform in any manner whatsoever;
d)any technological occurrences, glitches, technical failures, system breakdowns, disconnections, defects, delays, interruptions, improper data transmission, loss or corruption of data or communication line failure, distributed denial of service attacks, viruses, or any other such occurrences arising out of, or in connection with, your access to, or use of, our Platform; and
e)access of your user gaming account by any other person accessing the Services using your username or password, whether or not with your authorization.
We reserve the right to assume the exclusive defence and control of any matter for which you have agreed to indemnify us, at our own expense, and you agree to cooperate with and assist us, as may be reasonably required, in the settlement of any such matters.   

P. PAYMENTS AND PLAYER FUNDS   

You are aware and acknowledge that all financial transactions that take place on the Platform shall be in Indian Currency (INR).
Once you register on our Platform, we maintain a user gaming account for you to keep a record of all your transactions with us. Payments connected with participation in Cash Games have to be made through your user gaming account. All cash prizes won by you are credited by us into this user gaming account.
When making a payment, please ensure that the instrument used to make the payment is your own and is used to add cash into your user gaming account only.
Subject to the cash limits specified by us from time to time, you are free to deposit as much money as you want in your user gaming account for the purpose of participating in Cash Games on the Platform.
You may add cash in your user gaming account, using credit cards, debit cards, prepaid cash cards, or internet banking payment methods, that are processed through third-party payment gateways, subject to monthly limits, as may be prescribed by us, in our sole discretion, from time to time.
We are not responsible for any delay or denial by such third-party gateways. The processing of payments will be solely as per their procedures and terms of their respective policies, without any responsibility or risk attributable to us, in any manner whatsoever. In the event of any issue, in connection with cash addition, a complaint may be sent to us, in accordance with our complaint procedure provided in the contact details section at the bottom of this Agreement. Once a payment/transaction is authorized, the funds are credited to your user gaming account and are available for you to play Cash Games.
We want you to play responsibly on the Platform and have the right to cancel a transaction at any point of time solely according to our discretion in which case the payment has been successful, the transaction shall be reversed, and the money will be credited back to the payment instrument. You are not entitled to a refund of such transaction through any other mode.
You understand and agree that cash deposits in your user gaming account maintained with us are solely for the purposes of Cash Game participation on our Platform.
You also understand and agree that you cannot transfer any sum from your user gaming account with us to the account of another registered user on the Platform except as may be expressly permitted by us, subject to any condition, as may be prescribed.   

Q. TAXES AND SERVICE FEES   

We are legally obliged to deduct tax at source (TDS) on winnings of greater than, or equal to, Ten Thousand Rupees (INR 10,000/-) in a single tournament, a single Pool Rummy game, a single Deal Rummy Game, or a single Points Rummy game, as the case may be. In such cases, you will be required to furnish your Permanent Account Number (PAN), duly issued to you, by the Income Tax Authorities. If you do not possess a PAN, a TDS at the rate of 30%, or such other rate as may be prescribed by law, from time to time, will automatically be deducted from such winnings and the balance amount will be credited to your user gaming account.
We are legally obligated to provide you only an appropriate certificate of tax deduction and are not responsible for providing advise on your individual tax matters. You will be solely responsible to assess and report your individual tax to the appropriate tax authority.
Withdrawal of these winnings will only be permitted upon your providing your correct PAN details, in accordance with the withdrawal section hereinbelow.
We would like to inform you that we reserve the right to verify your PAN from time to time and to cancel any prize should your PAN be found inconsistent in our verification process.   

R. WITHDRAWALS   

Players can withdraw funds only if they have played Cash Games equivalent to the deposits they have made on our Platform. We reserve the right to confiscate the funds if any user is caught depositing money and placing a withdrawal request without playing games equivalent to the deposit amount. In any such case, the user will have to provide their bank statement clearly showing the deposit made into his/her user gaming account. Additionally, in all such cases, the withdrawal amount will only be refunded to the user gaming account on the Platform and will not be transferred to the user’s bank account. Any user identified engaging in such activities more than once shall have their accounts locked and any available funds in that account confiscated.
You may request to withdraw your winnings to any Bank Account, in the Indian jurisdiction, using an electronic bank-to-bank transfer or NEFT or any such other mode, and agree that all such withdrawals are subject to the following conditions:
a)The bonus or prize money withdrawal restrictions will apply.
b)You will be eligible to withdraw only when you have made at least one cash deposit on our Platform and thereafter played the requisite number of cash games.
c)We shall process a withdrawal request via Electronic Bank Transfer after the mandatory KYC and withdrawal verification have been successfully completed. We shall attempt to process such withdrawal via the mode of transfer selected by you. However, we reserve the right to modify the mode of withdrawal at our discretion and to reverse the amount to the payment/deposit mode used to add cash to our Platform.
d)All withdrawals on the Platform are currently free of any charge. However, in the future, if there are any charges to be levied on withdrawals, we reserve the right to charge the applicable fee which shall be notified to you in advance.
We will try to process all such requests within 24 hours of your making the request, and an additional time will be taken by the bank to process such a transaction. There may be a delay in remitting such payment, due to the time required for verification and completing of the transaction, which includes National and Bank Holidays or any other disruption of service. We shall not be held liable for any such delays.    

S. PROMOTIONS   

When you register with us, you will receive communications and notifications regarding special offers, updates, contests, account activities, etc. through SMSs, emails, and/or direct mails. You must ensure that your user gaming account is KYC approved, as mandated by law, to be eligible for any such offers including bonuses and promotional prizes. If any aspect of your contact information or KYC such as ID, address, email ID, or mobile number is not approved or verified, you shall not be entitled to receive any promotional amounts or prizes.

You must read the details mentioned, in their entirety as the terms and conditions may differ from offer to offer.You understand that you may not be able to claim a bonus offer in conjunction with any other offer offered by us at the time and will receive disbursements only for an active bonus code. Once a fresh bonus code has been activated, the previously active bonus code will automatically become inactive and invalid. The continuation of such promotions is in our sole discretion and may be recalled or discontinued without any prior notice. We are not responsible or liable for any loss arising from such cancellations. You are not entitled to any compensation whatsoever except for the applicable entry fee that may have been paid by you. The decision of our Management shall be final and binding in case of any disputes.   

T.Dispute Resolution   

If any dispute(s), controversy(s), or claim(s) arises out of, or in connection with, this Agreement, either in part or whole, the parties to the dispute shall use all reasonable measures to negotiate and amicably resolve the said dispute(s) controversy(s) or claim(s). In the event, a party is of the opinion that the opted remedies for resolving the said dispute(s), controversy(s), or claim(s) cannot be further proceeded with, after the expiration of 30 days or such longer period as the parties may mutually agree, and gives the other party a notice thereof, such disputes or differences will be referred to Arbitration in accordance with the clauses below and will be final and binding,
a)The Arbitration shall be in accordance with the rules of the Arbitration and Conciliation Act, 1996, in force at the relevant time (which is deemed to be incorporated into this Agreement by reference);
b)All proceedings of such Arbitration shall be held in the English language with venue and seat in Delhi. The Courts of Delhi shall have exclusive jurisdiction over such arbitration proceedings;
c)The Arbitration shall be conducted before a sole Arbitrator appointed by both/all the parties to the dispute and shall be final and binding on the parties;
d)The existence or subsistence of a dispute between the parties, or the commencement or continuation of Arbitration proceedings, shall not, in any manner, prevent or postpone the performance of the obligations of either party under this Agreement which is not part of the dispute. The Arbitrators shall give due and full consideration to such performance obligation, if any, while making a final award.
e)Nothing shall preclude either party from seeking an interim, or permanent equitable, or injunctive relief, or both, which shall not be a waiver of the right of either party to pursue any other appropriate remedy or relief through Arbitration.   

U. Governing Law AND JuRISDICTION   

The Terms and Conditions of Service shall be governed by, and constructed in accordance with, the applicable laws in India.   

V. SEVERABILITY   

If any clause is found to be unenforceable, that clause will be severed from this Agreement and the remainder will remain in full force and effect.
